The Joint Health Care Committee (JHCC), comprised of union, management, and non-represented employees, meets monthly to discuss system-wide health care issues. The JHCC recently reviewed actual health plan costs from FY09, and has heard the report and recommendations of a consultant following her review of UAs plan offerings and experience. GRIEVANCE and ARBITRATION HIGHLIGHTS University of Alaska Federation of Teachers (UAFT) ֱCollege of Rural and Community Development: The Union filed a Step 2 grievance alleging that the University violated Article 5.1.C of the CBA by changing the workloads of two faculty members at an extended campus from a tripartite to a bipartite assignment. The Step 2 grievance meeting is scheduled for 11/13/09. ֱCollege of Rural and Community Development: The Union filed a Step 2 grievance alleging that the University violated Article 9.1 of the CBA by placing two new faculty members at an extended site into the United Academics bargaining unit rather than the UAFT unit. The University is researching the issues. UA System: The Union filed a Step 2 grievance alleging that the University violated Article 1.3 of the CBA by not timely providing information to the union when requested. The University has provided the requested information and is awaiting notice of a withdrawal of the grievance from the Union. United Academics (UNAC) UAS School of Arts and Sciences: United Academics filed a Step 1 grievance alleging that the UAS policy of evaluating faculty members annually by the dean or designee is a violation of Article 9 of the CBA. The University denied the grievance at Step 1; the Union advanced the matter to Step 2. The Union and the University are discussing possible options to resolve this matter. UAS Business Administration: The Union filed a grievance alleging violations of the CBA and Regents Policy with respect to a faculty members evaluation for tenure and promotion. The Union has withdrawn this grievance. ֱSchool of Fisheries & Ocean Science: The Union filed a grievance on behalf of a faculty member who claims the university violated his right to academic freedom. The University denied the grievance at all levels. The Union did not advance this matter to arbitration. ֱSchool of Fisheries & Ocean Science: The Union filed a grievance on behalf of a faculty member who claimed the University violated the CBA by notifying him that his office would be relocated. The University denied the grievance at all levels. The Union did not advance this matter to arbitration. ֱSummer Sessions: The Union filed a grievance on behalf of a faculty member claiming that the University violated the CBA by altering compensation practices for summer session assignments. The Step 2 meeting took place on August 20, 2009. The University denied the grievance at Step 2; the union advanced the matter to Step 3. The Step 3 meeting was held on 09/25/09. The parties have agreed to suspend the timeline for the Universitys response at Step 3, and enter into settlement discussions on this matter. ֱOffice of Electronic Miniaturization: The Union filed a grievance on behalf of a faculty member claiming that the University violated the CBA by taking disciplinary action before conducting an investigation and by violating academic freedom provisions. The parties met and informally resolved the grievance. UAA School of Nursing: The Union filed a grievance alleging arbitrary and capricious reasons for changing the grade of a student over the objections of the faculty member. This issue was resolved at Step 2. ֱCollege of Engineering and Mines: The Union filed a Step 1 grievance alleging the CEM unit peer committee was appointed by the Dean in violation of the CBA and of the ֱRegulations for faculty evaluation. A meeting with the union has been scheduled for November 9, 2009. ֱSummer Sessions: The Union filed a Step 1 grievance alleging that the Summer Sessions program encroaches on the regular academic year in violation of the CBA. A meeting with the union has been scheduled for November 9, 2009. ֱCollege of Engineering & Mines: The Union filed a Step 1 grievance alleging that the funding structure for four faculty positions is inconsistent with the obligations of the University with respect to tenure track appointments. The parties met on November 3, 2009 and discussed the issue at length. Local 6070 ֱFacilities Services: The Union filed a Step 1 grievance on behalf of a unit member claiming discrimination. The University notifed the union that a discrimination claim cannot be pursued under the CBA and provided information on the proper method of filing discrimination claims. The Union withdrew its grievance. ֱFacilities Services: The Union filed a Step 1 grievance on behalf of a unit member claiming violation of the CBA with respect to discipline. The University denied the grievance on 11/4/09. ֱFacilities Services: The Union filed a Step 1 grievance on behalf of a unit member claiming violation of the CBA with respect to sick leave usage. The University denied the grievance on 11/4/09. United Academics Adjuncts No grievances are pending. NEGOTIATIONS UAFT: The Parties began negotiations for a new collective bargaining agreement on October 28-29, 2009. The current CBA expires on 06/30/10. UNFAIR LABOR PRACTICES and ISSUES BEFORE THE ALASKA LABOR RELATIONS AGENCY On October, 17, 2007, UAFT filed an unfair labor practice charge (ULP) with the Alaska Labor Relations Agency (ALRA) alleging that the University violated the CBA by its placement of new faculty with upper-division assignments into the UNAC bargaining unit. In response, the University filed a unit clarification petition, and effected service on all bargaining unit members per ALRA instructions. UAFT objected to the petition. On August 25, 2009, the ALRA accepted the Universitys Petition for Unit Clarification and placed the unfair labor practice complaints in abeyance pending the determination of that petition. A prehearing conference will be held with ALRA, UA, UAFT and UNAC representatives on 11/18/09. EMPLOYEE RELATIONS HIGHLIGHTS ֱTanana Valley Campus: A non-exempt employee at Tanana Valley Campus was non-retained pursuant to Regents Policy and University Regulation. The employee grieved the issue and requested a hearing. After motion practice, the hearing officer issued a dispositive order on 9/21/08 canceling the hearing and recommending that the ֱChancellor uphold the non-retention decision. The employee has filed suit in Superior Court challenging the Universitys non-retention rights. The parties have now submitted briefs in this matter. UA Statewide: An exempt employee on a term appointment was non-renewed pursuant to Regents Policy and University Regulations. The employee filed a grievance at Step 3, questioning the basis for the decision not to renew the term appointment. The grievance was denied at Step 3. The employee advanced the grievance to Step 4. The University sent the grievant a letter stating that the matter was not grievable pursuant to University Regulation 04.08.060.G; the request for a hearing was denied. UAA Enrollment Services: A non-exempt employee was terminated for cause pursuant to Regents Policy and University Regulation. The employee filed a grievance and a hearing is pending. UAA Police Department: An employee was terminated for cause and simultaneously non-retained. The employee filed a grievance, and a hearing was held in March. The hearing officer recommended upholding the termination and the chancellor agreed. The employee filed an administrative appeal on 7/21/09; briefing has not yet begun. UAA Community and Technical College: A term faculty member's contract was not renewed in May 2008. The FM thereafter filed a number of complaints/actions: a discrimination complaint based on disability regarding the alleged withdrawal of a summer assignment. The investigation and subsequent review at the chancellor level found no discrimination had occurred. The complainant filed an administrative appeal on May 26, and the university sought dismissal on the basis of lack of jurisdiction to appeal an investigation. Briefing is completed. The complainant also contacted UAA HR in August 2008 regarding a 2007 hire, asserting that she was not advanced past the interview stage of a recruitment to ensure the hire of a spouse of a department member. The HR review indicated that the process was appropriate, including that the spouse was not involved in the search and that the chair of the committee was not from the department. The complainant has filed a civil suit alleging numerous causes of action including disability discrimination, violation of nepotism laws, and whistleblower retaliation.
