The parties have contacted the Federal Mediation and Conciliation Service to request committee training. The Joint Health Care Committee (JHCC), comprised of union, management, and non-represented members, met on March 19 and 20 in Anchorage. A quorum was present. The committee reviewed accounting methodology and voted on a recommendation to the University on FY09 employee health care charges. The next meeting is scheduled for April 30 in Fairbanks. GRIEVANCE/ARBITRATION HIGHLIGHTS Alaska Community Colleges Federation of Teachers (ACCFT) No grievances currently pending. United Academics (UNAC) UAA School of Nursing: United Academics filed a Step 1 grievance alleging that a bargaining unit members workload was improperly altered by the College. The Union asserts that the contractual process to revise a workload was violated and that workloads for all faculty members are not timely completed by administration. The grievance has progressed to Step 2 and a decision by the provost is pending. Local 6070 UAA Kenai Peninsula College: A bargaining unit member was terminated for reporting to work under the influence of alcohol. The Union filed a grievance, asserting that there was no just cause for termination. The parties settled the matter and the grievance is withdrawn. ֱSchool of Fisheries: The union filed a step 3 grievance alleging that the University failed to follow required contract processes when it placed two bargaining unit members in layoff status. The parties continue to discuss possible resolutions. ֱFacilities Services: The union filed a step 3 grievance alleging that the University violated Article 10.4 of the agreement by failing to post vacancies internally for five days before posting them externally. The parties are exploring the issues and discussing possible resolutions. United Academic Adjuncts No grievances are pending. UNFAIR LABOR PRACTICES and ISSUES BEFORE THE ALASKA LABOR RELATIONS AGENCY On October 17, 2007, ACCFT filed an unfair labor practice (ULP) with the Alaska Labor Relations Agency (ALRA) alleging that the University violated the collective bargaining agreement by its placement of new faculty with upper-division assignments into the UNAC bargaining unit. The University asserted to the ALRA that the unfair labor practice should be converted to a unit clarification petition, with participation by ACCFT, UNAC and the University, because the dispute involves interpretation and application of both the ACCFT and UNAC recognition clauses. UNAC has joined in a request to ALRA that the unfair labor practice be converted to a unit clarification action. ACCFT declined to join in the petition for unit clarification and the ULP and unit clarification petitions will proceed as separate actions before the ALRA. The University and ACCFT have scheduled an April meeting to discuss the issues. EMPLOYEE RELATIONS HIGHLIGHTS (UAA Consortium Library): A non-retained employee filed a grievance alleging violation of Board of Regents Policy and University Regulation in the processing of her non-retention.
